Appendix 1 Design -Is it faulty?

Post by Jignesh Gorasia » Thu Dec 11, 2008 12:04 pm

Would like to highlight a very frustrating experience..

The entry clearance has been refused as no points were awarded for English Language Area.

The ECO's comments: "You have stated that your degree was taught in English. However, the two certificates you have submitted do not show this. You have not provided any other documents to support your English language ability...."

Complaint #1:

* I had submitted three documents. The original certificate , the original transcript as well the compatibility letter from UK NARIC. I have been given points for Qualification area, the same three documents have been used as the supportive documents.
* Part 6 of Appendix 1: Self Assessment clearly says , in 6.5. that you should hold a degree that was taught in English, that is deemed by UK NARIC to be equivalent to at least a UK Bachelor Degree. As per 6.6 & 6.7 , I had submitted the UK NARIC letter and the original degree certificate and transcript.

What other evidence ECO wants ? is the Appendix 1 not properly designed ?

The original certificate & transcript (from Indian Institute of Management, Calcutta) are in English. Very unlikely that the institute would teach the degree in some other language , but would issue the certificates in English!

Complaint#2 :
The processing time has been 34 working days (I submitted on 29-Oct-2008) and the application was refused on the basis of the lack of documentation submitted ! Now, Do I have to wait for another 28 days under Administrative Review ?

Sorry to hear about your case.

As for English language ability, the documents you have provided are enough. Besides this the points based calculator should provide your Institute/Degree 10 points. Nothing else is required.

I dont think that NARIC would have missed IIMC in any case. :)

The only way out now is to apply for an Admin Review. Besides 28 days is just there on the website. My AR has been pending for over 2 months now.

Regards,
Amit

I got the certificate from US and I was still told to show documents that clearly stated that the degree was taught in English.
