Query on Dependent Visa status after getting ILR

Hi All,

Hope you are well and keeping safe.

Raising this query as I’m having some doubts on the ILR Processing. It would be great if anyone can provide some guidance in this regard.

I’m currently on a Skilled Worker Visa (PBS visa valid till 31 December 2024) and my dependents (spouse and son) are staying in the UK on Skilled worker dependent (Dependent visa also valid till 31 December 2024).
I’m eligible to process my ILR on the 10 years continuous stay, long residency route and having the following questions on the Dependent visa status of my dependents post filling the ILR request:

1. Will my dependents be able to continue to stay in the UK on the current PBS Dependent visa once ILR is granted to me or I need to file DLR request for my dependents once my ILR request is granted?

2. Does the skilled worker dependent visa (PBS dependent) of my dependents get cancelled once I get ILR ?

3. Do I need to file the DLR request for my dependents once I get ILR?

4. In case I need to apply for a DLR for my dependents, within how many days this needs to be done after I get ILR?

Thanks in advance for your help and cooperation in this regard.

First of all, are you sure your visas are all valid till December 2024? This is the date when all BRPs expire, but not visas.
I highly encourage you to check the decision letters for actual end dates, if you were using BRPs for that. Visas are most likely longer than you think.

Yes to both.

Where did DLR come from?
Your dependents need 5 years of stay as your dependent. They can extend via FLR as usual extension process.

Dependents can remain on PBS Dependent visas, there is no need to change visa categories if the OP gets ILR based on 10 years long residence.

The rules changed regarding this earlier this year.
