ILR Set(O) queries

Post by Shwetha14 » Thu Sep 07, 2023 1:57 pm

Hi,

I am on Skilled worker visa and due to apply for my ILR soon.

I have few queries, could you please help me on these questions.

1. I started working with my current employer from March 2017. When I started my job I was on Tier 2 ICT dependent visa. On August 2018, I switched from Tier 2 ICT dependent to Tier 2 General (Skilled worker).
In employer letter which we provide to support ILR application, is it ok to mention the start date of my actual employment which is 23rd March 2017 or should it be the start date of Tier 2 General Visa approval date which is 30th August 2018.

2. In the absence letter, is it required to mention all the absences (Annual leave taken on each year) or only the absences outside the UK. I have travelled only twice (less than 28 days each time) during last 5 years.

3. Also I was on maternity leave in the year 2022 and i was in the UK itself. is it necessary to mention the maternity dates as well in the absence letter?

4. My dependent partner is also applying with me and we need to provide Cohabitation Letter for last 2 years. Is it enough to provide last 2 years of Council tax and utility bill which has both our names ? do we need to submit any documents which addresses to individuals as well?

5. my husband is switched tier 2 general dependent from Tier 2 ICT within UK, we need to enter first entry to the UK as BRP start date. Is that correct?

6. For dependent absences, there is a question "Does the period of stay on which this application was based include any leave granted since 11 January 2018?". His Tier 2 dependent visa is approved in October 2018 and we are providing all the absences taken on or after October 2018. Since the question is referring to 11th Jan 2018, he has travelled outside UK in March 2018 (when he was on Tier 2 ICT visa), do we need to mention the march absences as well?

7. For the question "Have you previously lived in a country outside the UK including your country of birth?",
my immigration history outside my country is as below.
--- I came to UK on tier 2 ICT dependent (Short-term) visa on October 2015 and stayed in UK only for 3 weeks. This is mainly to collect my BRP.
---again in Oct 2016, i came to UK on tier 2 ICT dependent (Long term - 3year visa) visa and stayed only 2 weeks and later returned to UK on 30th jan 2017. From that day i am continuously staying in UK.

Country you lived in: My home country
Date you lived there from: my date of Birth
Date you lived there to should this be 22 October 2016? or 30th Jan 2017? or should this my skilled worker visa arrival date?
Reason you lived there: I was Born here.

Please advice

Thank you.

Put the start date of the period you arr basing your 5years to ILR on.

2. In the absence letter, is it required to mention all the absences (Annual leave taken on each year) or only the absences outside the UK. I have travelled only twice (less than 28 days each time) during last 5 years. Outside UK

3. Also I was on maternity leave in the year 2022 and i was in the UK itself. is it necessary to mention the maternity dates as well in the absence letter? No need.

4. My dependent partner is also applying with me and we need to provide Cohabitation Letter for last 2 years. Is it enough to provide last 2 years of Council tax and utility bill which has both our names ? do we need to submit any documents which addresses to individuals as well? Any item of correspondence covering last 2 years. 6 if addressed to you both or 12 if addressed individually, spaced 3-4months apart and from at least 3 sources.

5. my husband is switched tier 2 general dependent from Tier 2 ICT within UK, we need to enter first entry to the UK as BRP start date. Is that correct?

6. For dependent absences, there is a question "Does the period of stay on which this application was based include any leave granted since 11 January 2018?". ALL absences from any leave granted 11th January 2018.
