Eligibility for Registering as British Citizen

Post by sreekan2 » Fri Jan 06, 2023 9:55 am

Hi All, I got a question about my daughter's "registering as British Citizen".

I am a British citizen by naturalization,
my wife and 8-year-old daughter are currently on a family visa and will be eligible for ILR in Jan 2024(5 years completed),

Can I apply for ILR for my wife and apply for registration as a British citizen for my daughter at the same time?

Thanks in advance

Your daughter need ILR first. I'm guessing she wasn't born here.

My wife entered in the UK on 19-08-2018, so can I apply in Aug-2023(current visa valid until Jan-2024), if she receives ILR before my daughter's visa expiry(Jan-2024), then can I apply for "registration as British Citizen" for my daughter?

Why would you think that's possible? For anyone to be granted British Citizenship, they need to be free from immigration restrictions. That's what ILR is.
How have you then disregarded what I've said and gone back to your original assumptions.

If your daughter was born in the UK, then that's different.

No, I haven't disregarded your suggestion,
I am just trying to clear my doubts,
so for any children born outside the UK, they must hold ILR before applying for British citizenship?
Thanks

Also see this almost identical thread.

Both the other parent and the child need to either have ILR or have resided in the UK for 10 years in order for the child to be able to register for British citizenship.

Child eligibility for Naturalization

Post by sreekan2 » Tue Sep 26, 2023 8:44 pm

Hi Guys,

I am currently holding British citizenship.
my daughter was born outside the UK (I was on a Tier 2 visa then), and she has been ILR dependent for the last 5 years.
My question is, is she eligible to apply for naturalization without applying for ILR?
My wife is also ILR dependent along with my daughter.

Thanks in advance.

1. Topics merged

2. The advice remains the same as when you asked in January!! Not sure why you believe anything has changed. The child needs ILR first before you can register her as british.
