EU presettle under Surinder Singh for dependent parents 2023

Hello,

Can some one help me with my question on eu presettle for dependent parents…

Basically, I would like to apply for eu-presettle for my parents (non-eu) who are dependent on me financially and also require support from me due to age factor.

Regarding my situation, I have eu-presettle under surinder singh (spouse is a British citizen only) where my status says qualified family member or British citizen.

The website on uk immigration is round in circles and only mentions eu citizens and dependents only

I want to understand how can I apply for my dependent parents under eu presettle please?

To qualify, they would have had to reside in the other eu state with the british citizen as dependents under rhe eu rules and move with them back to the uk to invoke surinder Singh rule.

I’m afraid that wasn’t the case within the eu as they were living outside eu that time.

I can see there is a qualified family member born in Northern Ireland case as well for Eu settlement

Is there a route establish as a family member born in NI for a non-eu family?

What exactly are you referring to? What exactly have you seen.

As per Gov UK website - Apply to the EU Settlement Scheme (settled and pre-settled status)

“Applying if you're the family member of an eligible person of Northern Ireland

You can apply if you have a family member who is an eligible person of Northern Ireland. You do not have to be from the EU, Switzerland, Norway, Iceland or Liechtenstein.

The person of Northern Ireland who is your family member must:

- be a British, Irish or dual British and Irish citizen
- have been born in Northern Ireland
- at the time of their birth, have at least one parent who - held British, Irish or dual British and Irish citizenship (or - was without any restriction on their period of residence)
- have been living in the UK by 31 December 2020”

All the conditions are true except the last one whiter the NI person born after 2020.

What to do?

Keep in mind that you would have to prove dependency on the relevant family member.
You’ll also have to show that you are dependent on them if:

you’re their dependent parent or grandparent and your family member is under 18 (or was under 18 on 31 December 2020 and you were living in the UK by then)
Examples of the evidence you can provide include:

bank statements or money transfers that show you depend on them financially
evidence that shows you depend on them for health care, for example a letter from a hospital consultant

Other than that, if you think your parents satisfy the criteria and you can fulfil the obligations, applying for EUSS family permit seem to be the logical option (and the application is free).

I'll let others provide better guidance as I'm far from an expert on EUSS.

Yes, the sponsor is a child - so the relation is grandchild

However, there are questions asked on

1). why the sponsor couldn’t return by December 2020
- (Not born)
2). Provide details of how you are dependent on sponsor (child is a sponsor here), a member of their household, or in strict need of their personal care on serious health grounds
- (not directly dependent on child but on me)

For eg. My parents are dependent on me financially and disabled so under treatment over 5 years now. (Regular care under specialist consultant)

So the part of eligibility is there directly but then not directly on other questions since the sponsor is child.

What to do then?

I am unable to find any route that would allow you to bring your parents to the U.K. other than as adult dependent. This is possibly the hardest most difficult visa route to fulfil and you have already stated they are being medically treated in their home country. Therefore it fails on this criteria alone.

Quite a thing -
If your child was born after 31 December 2020, you can still apply to the EU Settlement Scheme for them. You can apply for your child or they can apply for themselves. You'll need to prove how they're related to you.
People born after can be sponsored but they can’t sponsor anyone!
