Advise needed regarding my dependent please!

Hi

I am on tier-2 visa and my wife is on PSW visa which is valid till April 2024 we have a two and half year old daughter who was born here in UK, both my wife and my daughter left to India on an emergency issue
I have got my tier-2 approved recently While they were in India and as my daughter didn’t had any visa I had been to India and applied for tier-2 child Dependent visa on priority basis and had submitted the parents consent form notary and everything needed it’s been more than 8 weeks I have no communication from them apart for the email stating we are looking into the case and it may take time in the second week after applying . Can someone kindly suggest if there is something that I can do? Please help

Can someone please advise if I have to wait for my daughters visa or apply for my wife’s visa as a tier-2 dependent ? And whether to apply from India or UK?

Your daughter will not get a visa with a validity longer than your wife's current visa, the child's visa if granted, will have an expiry date of April 2024. The rules don't allow children to have a visa duration longer than the parent with the least amount of valid leave.

You should have applied for both of them at the same time.

I have applied my daughters visa under tier-2 child dependent and my wife psw visa was how ever valid till April 2024 so thought she could come to uk and apply but now she is stuck in India waiting for my daughters visa, can someone kindly suggest if we can wait to apply for my wife’s visa or is it wise to apply now and applying from India or Uk what is wise? And is my daughters visa anyway linked with my wife’s visa? Sorry that I am asking too many questions but we are away from each other for long please guide us the right way possible.

Your choice. It doesn't change the fact that if your childs visa is granted, it will expire at the same time as your wifes PSW visa.
And is my daughters visa anyway linked with my wife’s visa?
In terms of visa length and validity, yes, it will expire when your wifes visa expires, which mean you will have to apply again for a child Skilled Worker visa and pay the fees and IHS again.

Thanks for the info by any case if I call my wife here to uk and apply tier-2 dependent here on priority basis she might get it before my daughters visa decision so would that help?

In this case if I withdraw the daughters visa application and apply for both my daughters and wife’s visa together as tier-2 dependents will that be better? And I had paid IHS fee for three years if she is granted same visa as my wife which is valid only till April 2024 will I get a refund for the rest period?

And if I withdraw the visa application now I will only get the ihs refund right the priority visa fee and the visa application will be lost?

Please can someone suggest the best way possible to get my dependents here.
