Dependent in toxic relationship

Post by Inky1 » Wed Nov 08, 2023 6:47 pm

So here goes i am here on a dependents visa. I have been the main form of income for almsot all of the 5 years. With less than month to go my partner has been using position of being the main applicant as a form of power to manipulate me and does not stop there. We have children together but none born in the uk. They are now excluding me from anything relating to our immigration status. So i guess i am trying to ask what are my options. I have no idea where to even begin if you have any guidance on options to stay close to my children. Would i be able to apply for ILR based on being in the country legally for 5 years and having paid taxes etc for the full time i have been here.

What visa category exactly do you hold and your partner holds? There are many different dependent visa categories, all with different rules.

You cannot apply for ILR independently without your spouse who is the main visa holder. You will only qualify for ILR when your spouse does. Working and paying taxes for 5 years is irrelevant regarding qualifying for ILR.

What you can do, is find a visa you qualify for such as a Skilled Worker visa with a sponsoring employer if you meet the requirements.
