ILR Category B spouse 2 jobs in last 12 months

Post by vsk1988 » Tue Dec 05, 2023 6:55 pm

Evening all,
I just need some clarification for my spouse who will be my sponsor.
He has had 2 jobs in the last 12 months. He started one just under 2 months ago which is a fixed term contract.

Both jobs annual income is easily over £18600.

But I am confused as to how is income calculated in each of the two pages in the Set(m) form where they ask about the two jobs annual gross income before tax.

Oct 23 - November 23- gross salary earned is £6072
Dec 22 - Oct 23 - previous job salary earned is £46,872

Can someone clarify what I need to put in the application form where there are two questions for both jobs salaries?

Thanks so I read that forum thread. So to apply it in my case, my current employment started mid-month (19th October) so approx 1.5 months.

Will it suffice if I base the annualised salary based on 1 full month payslip i.e November-23? This would be £4,290 x 12 months = £51,480. As the salary is fixed every month but it was pro rata in October-23.

And does it matter if it fixed term contract or temporary?

Yes, that is only part 1 of the requirement. The type of contract does not matter

Ok. So the for the second question on the form regarding my previous job , it will be calculated as my last 12 months earnings rather than the annual salary? I.e from December 22-october 23.

And is the my current job employment letter compulsory? I have a contract copy so will that suffice for the documents to be sent...

Thanks again

You have to meet 2 requirements:

1. From the date of application to 12 months prior Gross salary from employment should be £18,600 or above. (For example I applied for my wife on 3rd Dec and provided Payslips for period Dec 2022 to Nov 2023)

2. At date of application Gross salary from current employment should be £18,600 or above proven by your last payslip and employment letter stating the requirements as listed under Appendix FM.

Yes I understand that. Is employment letter from current employer compulsory? Or will contract copy suffice ?

Employment letter is complusory.

Contract of employment is not required and not asked for.
