Assisted conception, husband has ILR, the wife has dependent visa

Dear members,

Me and my partner are trying to have a baby. We have been referred to a NHS hospital for fertility treatment. I have an ILR but my wife does not have it yet. She has a PBS dependent visa and is not ordinarily resident in the UK yet.

We were told that we would need to pay 65% of treatment in case we decide to go ahead with treatment. As far as I am aware, assisted conception is not funded by NHS if you do not have ordinarily resident status in the UK. However, the hospital insists that we need to pay 65% of the treatment. 35% would not be paid because one partner has ILR.

We do not want to breach immigration rules and we're ready to pay full if needed. Has anyone experienced such an issue (partial payment when one partner has a ordinarily resident status)?

Not sure what you mean by this. This is NOT the same as holding ILR. Two completely separate things.

Presumably your wife LIVES in the UK??

How long has she lived here??

Does she or has she spent a lot of time out of the UK?

Ordinarily resident means someone has a settled status (ILR or British Citizenship). My wife has been living in the UK for 1.5 years with a PBS dependent visa

No it does not mean that in immigration terms. The guidance does clearly state living in the UK Lawfully, which is someone holding a visa, not a visitor.

You can hold a time limited visa and still be ordinarily resident, ie you live in the UK, not just visit.

We are in a similar situation I am British and my wife is on spouse visa. Recently GP referred for IVF and few days back GP informed that IVF has been approved and now we have to wait for a letter as there is a waiting time of 6 months. Please let me know at what stage did they inform you of 65% cost? Was it after the referral or after approval they do all these checks? I want to know if our referral has been approved, will they still find out later and charge us?

We were referred by our GP and we had a initial consultation session with a doctor/specialist. She recommended IVF treatment and informed us that if we decide to go ahead with the treatment, we should pay 65% of the cost. We have not decided to go ahead yet.
