NEED HELP PLEASE! EU TREATY RIGHTS

Post by pashoumamy » Mon Dec 15, 2008 10:32 pm

Hello
I am a 33 years old lady who got married with a french citizen in 2007.
I applied for a residence and received it. Thank you for that.
When i applied i did not know i had to make the application together with my son's as my son is not the son of my husband.
I got advice from the Home Office and been told that i have to make an application for my son using EEA2. they told me also my son depends on me not on my husband. Meaning that if i have a residence he will have the same. But he cannot be french because my husband is not his dad.
I am not sure how to fill the form. I have try calling the home office many times now and th line is always busy. Can someone helps me?
Husband: french on training studies to become a teacher
Mother: Senegalese and got her residence card working as a marketing assistant
Son of the mother: 2 years old, does not have senegalese passport as he needs to go o senegal to make one (Embassy in London does not provide passport)

Can baby applied for residence card as mother. If so how? How to fill the form? as son depends on mother not on husband?
what documents should include in the application?
Son does not have passport but can get immigration status document? If yes how?

Thank you for replying

Why didn`t you include your child in the EEA2 application when you applied for yourself?
If the child was living with u then both mother and child are dependants of the EEA citizen and should be issued with a resident card.
I would think that you will have to reapply with EEA2 form including ur child as dependent with all the paperwork prooving marriage and exercising treaty right+ child birth certificate.Hopefully with a cover letter explaining the situation it should be not too long but I might be wrong so wait for other replies on the board or ask a lawyer.
Good luck.

Can`t you ask the embassy to add your child in your passport?
Without any form of ID for the kid you will not be able to take him anywhere outside the UK.

Hello

At that time when i applied for myself i thought my embassy would be able to include my baby in passport but afterwards when i asked to, i have been told it was not possible anymore. So i have to apply now for him.

For the passport not sure but i have been told they will issue him a his residence card on a separate document.
