Inquiry for Indefinite Leave to Remain

Post by Shov83 » Sun Dec 17, 2023 1:23 am

I have been completing around 10 years in UK by Mar'24, however I do have 2 breaks for more than 1 year. I stayed with my family from May 2011 to Nov 2013, and Jul 2015 to Mar 2018 on Tier 2 ICT Visa. For this instance, I came UK on Tier 2 ICT Visa in May 2019, and switched to Skilled Worker Visa in Apr 2021. So I would be completing 5 years in Apr-24 without any breaks but on 2 different type of Visa.

My query is, am I eligible to apply to leave to remain or ILR?

Thanks Shov

No you are not eligible for ilr yet. Ypu need 5 yeara on your current visa to qualify for ilr. The time in tier 2 ict doesnt count for ilr based on 5 years.

You dont seem to qualify for ilr based on 10 years long residence either due to long absences.

Thanks for your response. Are there any exceptions can raised if yes what kind of exceptions usually acceptable?

Discretion is rarely exercised. You need to demonstrate that the long absences were totally out of your control.
