ILR Timing Question

Post by LarelleCampos » Mon Dec 18, 2023 1:16 am

Morning all,

Hopefully someone can help me, I want to check my timing for when I can apply for ILR as a spouse (5 year route) so I can match cohab documents so its not a rush nearer the time ..

I understand it can be 28 days before 5 years of being in the UK but what about holidays out of the UK, are these taken into account? I've been out 3 times - twice for a week and once for about 2 1/2 weeks? ..

Heres my timeline

Spouse Visa
Date Issued (BRP) - 17/02/2020
Date Arrived in UK - 06/03/2020
Valid Until (BRP) - 29/11/2022

FLM(M)
Application Made - 18/11/2022
Biometrics 15/12/2022
Date Issued (BRP) 04/01/2023

Does the 30 month FLM Start from the application / bio or date issued date? My BRP has a expiry date of december 2024 reading up due to the change over to online and we used a solictor to do the FLM so they received the acceptance email (we have contacted them to get this date but theyve yet to come back to me grr - but my guess is 30 months from date issued? so probably around the 4th July 2025 but will get this confirmed!)

So whats the earlest / latest date I can apply for ILR?

Im thinking earliest will be 6th March 2025 (-28 days so could apply Feb 2025) e.g. 5 years from the first day I arrived to anytime before my FLM Expires so 4th July 2025 (Date TBC)

Thankyou
