Settlement - 10-year Family Route

Hi All,

My son completed 10 Years under child route has he was at the time of first application under 18 and lived in the UK continuously for at least 7 years. And similarly, I have completed 10 Years under parent route as I am a single mother and have sole parental responsibility for my son. We are both Indian Passport Holders.

We both are now eligible to apply for settlement as a parent and settlement as a child (although he’s now over 18) at the same time. Can someone please direct me to the correct online forms for myself & my son.

You can either go SET(LR) for settlemnent under 10 years of lawful residence ( https://www.gov.uk/government/publicati ... form-setlr ) or through your respective 10 year routes (you can find links here - https://www.gov.uk/indefinite-leave-to-remain-family/ ).

Clearly states "If you are the spouse or partner of someone who is settled and currently living in the UK and you have completed the relevant period of continuous leave in the UK using the 'Family Route', you cannot use this form. You must instead apply using the form Apply to settle in the UK - Partner of a person or parent of a child already settled in the UK."

From my understanding of the above, SET(LR) form doesn't apply for both of us right, kindly confirm.



+ SET(M) Online Form - https://visas-immigration.service.gov.uk/product/set-m

Clearly states "Do not use this form if: your current leave to remain is as a partner or parent on the 10 year family route. This means you have had permission to stay in the UK for at least 10 years. Applications for settlement on that route will open on 20 June 2022 when the new ‘Settlement as a partner or parent’ and ‘Settlement as a child (including a child aged over 18 already in the UK as a dependent)’ forms will be available on the gov.uk website"

From my understanding of the above, SET(M) form doesn't apply for both of us as it is for applicants on 5 year route, kindly confirm.

They must either be applying for settlement at the same time as you or have already settled in the UK. or have permission to stay as a partner or parent (or a combination of the two) on the family route and are eligible to settle in the UK after a qualifying period of 10 years."

From my understanding of the above, Settlement Adult Relative Online Form is the one that applies to me as I have completed 10 Years on Parent Route, kindly confirm.

Clearly states "Use this form to apply to settle in the UK if you are the child of someone who has:

From my understanding of the above, Child Settlement Online Form is the one that applies to my son as he completed 10 Years on Child Route, kindly confirm.

You have racked up 10 years of lawful residence, which is what this form is for.

Use this form if you have lived in the UK lawfully for 10 years continuously and now want to apply to settle in the UK.

Alright understood, thank you! I have just compared both the SET(LR) and the Settlement Adult Relative plus Child Settlement online forms.

I found the SET(LR) got financial questions and other extra questions which are irrelevant under 10 year parent route and child route. Its also asking for more supporting documents compared to the the other two applications.

Could I apply through Settlement Adult Relative & Child Settlement respectively as they seem to be more specific for the route we are under with only relevant questions. In general it is very short and specific.

SET(LR) long residence has NO financial requirement at all and your current visa is irrelevant. The financial questions are generic. SET(LR) is the most straightforward path as you have been advised. FYI Child settlement form is NOT for over 18-year-olds.

Correct. There are multiple paths to ILR. The advice remains the same as before

Wouldn't the caseworker either way consider both requirements vice versa?

Under the long residence, they do not care about the current visa route you are under. It is the most straightforward path to ILR if eligible

Yes we both overstayed our visas for a very long time until we both were given Leave to Remain on 10 Year family route - Single parent with sole responsibility of my son under 18 at the time of our application in September 2013.

Since 2013 we have now completed 10 years of continuous and lawful residence in the UK and are now eligible for settlement.


PS. The attached decision letters have the same wording for all 4 applications made since 2013.

Hi, further to the application made in February, I have now received an email from home office as follows:





Initially with the application I have submitted the mandatory documents & also the following documents: divorce order & custody of my son (sole responsibility), my sons birth certificate, our both electoral polling cards addressed to our home, tenancy agreement, medical history documents for both, latest photo of us together.

I would be grateful if someone can please advise on what other documents I should send in order to prove my active parental relationship?

My son is 28 years old and I support him emotionally, sometimes financially & he lives with me at the same address but how do I prove this with evidence?
