BRP renewal question

Post by martinsc » Thu Jan 11, 2024 2:12 pm

Hello

I’m new here. I’m seeking some advice for my partner who is Pakistani. Her English isn’t too great, so I offered to come on here on her behalf.

I will cut to the chase. My partner was granted ILR status in 2019. She later received her BRP which was valid for 5 years. This is due to expire in September of this year. My partner’s very anxious. I’ve tried to allay her fears but she’s under the impression that if she does not renew her BRP BEFORE it expires then she may be stripped of her ILR status.

So, my questions are: ILR status, in the exception of a person leaving the UK, is PERMANENT and cannot be stripped from them, right? Also, does this remain the case if their BRP expires but they REMAIN in the UK? They’re not at risk of losing their job, home, benefit entitlements, etc?

I understand that a BRP should be renewed SIX MONTHS before its expiry date. Is there a means for a person to do this online, e.g. via the government website? Is there a fee? And should they consult a solicitor? They’re not at risk of jeopardising their application should they NOT use legal representation?

It is right to say that a BRP’s main use is for travel purposes? Will they be phased out in 2025? If so, is there any point to renewing a BRP that is about to expire? Could one experience real problems if they don’t?

It will be greatly appreciated the answer to all or any of the questions.

Thanks.

So, my questions are: ILR status, in the exception of a person leaving the UK, is PERMANENT Yes and cannot be stripped from them, right Wrong, it can be stripped easily for a myriad of reasons. Nothing to worry for law abiding citizens though.? Also, does this remain the case if their BRP expires but they REMAIN in the UK? No problems, you might need something to prove residency though and right to work if she changes jobs. They’re not at risk of losing their job depends on employers, some don't know the rules, home, benefit entitlements, etc?

I understand that a BRP should be renewed SIX MONTHS before its expiry date. Is there a means for a person to do this online, e.g. via the government website? Yes Is there a fee? And should they consult a solicitor? They’re not at risk of jeopardising their application should they NOT use legal representation?

It is right to say that a BRP’s main use is for travel purposes? Will they be phased out in 2025 Correct? If so, is there any point to renewing a BRP that is about to expire? There should be clarity on how next to proceed soon enough Could one experience real problems if they don’t? Not really, depends on circumstances.

It will be greatly appreciated the answer to all or any of the questions.

Thanks.
No sin in failing, you just have to try and try again!

Thanks for the reply.

One more thing. Would you recommend my partner applied for her BRP renewal online herself WITHOUT legal representation? If she does, may it affect the application process?

Note that BRP is to.indicate status or evidence of her ILR. The BRP is being scrapped this year hence why any and all current BRP ends last day of the year.
HO is rolling out an electronic means of evidencing status. If there is no travel outside UK planned, renewing a BRP tht is to expire in September may not be worth it.
