SW Extension for 2 years

Post by mapsan » Tue Feb 06, 2024 11:17 am

I plan to apply for a software (SW) extension with the same company I have worked with for the last three years. It is now clear to me that even though the Certificate of Sponsorship (CoS) they provided three years ago was valid for five years, it is no longer valid.

(uk-skilled-worker-visas/5-year-cos-vali ... 43460.html)

However, since I will be eligible for Indefinite Leave to Remain (ILR) in two years, I have two questions:

1. Should I request a CoS from my company for only two years? (Meaning, will they need to pay only for two years?)
2. Should I apply for an extension of only two years, if possible? Or is it only possible to apply for a minimum of three years, implying that we will still have to pay for everything, including the Immigration Health Surcharge (IHS) and visa application fee, for at least three years?

As I cannot edit my first message, of course SW stands for Skilled Worker nothing to do with software or anything, just an autocorrect issue.

Your employer will have to issue another COS and they can decide what the length of validity it will cover. A COS can be issued for any period up to five years, so the employer can issue for a period that would take you through to your ILR application.

The period stated on the COS - say two years - you will have to pay the application fees and IHS for the appropriate period.
