10 Yrs Long Route from TIER 2 Dependent - Application Support

Post by summer_24 » Sun Feb 18, 2024 3:46 pm

Hi All,

I need your support for my ILR application which I am planning to submit in next couple of weeks.

Summary of my status:

Me and my kid are under my husband's TIER 2 Dependent visa and our visa is valid until Nov 2024. Recently, my husband has moved to ILR based on 10 year long route. Both me and my kid would be completing 10 years by March 2024. From 2014 onwards, we were been on Dependent visa under various visa type

2014 - 2018 ICT TIER 2 Dependent
2018 - TIER 4 Student and my son as my dependent
2021 - TIER 2 General Dependent

I am very well within the overall 540 days and once I had to travel outside the country for 172 days at a stretch.

My Questions are:

1) Will there be a separate application for me and my son or both of us have to submit one single application SET (LR). My son would be 12 years when we submit the application.

2) After our visa approval we entered UK on 31st March 2014. My assumption is we are eligible to have our biometrics any time from 2nd March 2024.

3) I have received a 3 endorsement points for speeding offence 2 years back but it was not a court offence. I hope this will not have any impact on my application.

4) My son has been in the uk for 10 years however he was born outside UK. Is there any chance for him to go directly for British citizenship since his dad has already got a ILR.

5) I have been doing part time but haven't filed any tax so far. As the income is very less. I know there won't be any question related to this on the application still do i need to be prepared on this.

6) I will be submitting my Life in UK test details and apart from that I have done a masters degree in UK hence i think i don't have to go for NARIC certificates.

Could you kindly share your inputs on the above questions. Thanks in advance.

1) Will there be a separate application for me and my son or both of us have to submit one single application SET (LR). My son would be 12 years when we submit the application.
Set LR does not allow dependents to be added because EACH person apply must meet the requirements on their own. You have to complete a separate application form for each person applying.
2) After our visa approval we entered UK on 31st March 2014. My assumption is we are eligible to have our biometrics any time from 2nd March 2024.
Yes, apply online within 28 days before reaching 10 years. Biometrics appointment is just that, biometrics enrollment. Your date of application is the date you submit and pay online.
3) I have received a 3 endorsement points for speeding offence 2 years back but it was not a court offence. I hope this will not have any impact on my application.
You need to declare them.
4) My son has been in the uk for 10 years however he was born outside UK. Is there any chance for him to go directly for British citizenship since his dad has already got a ILR.
No, he needs ILR first. He has not entitlement to British citizenship if he was born abroad. His father holding ILR is irrelevant if he was born abroad.
5) I have been doing part time but haven't filed any tax so far. As the income is very less. I know there won't be any question related to this on the application still do i need to be prepared on this.
Do you work for a company and get paid through payroll or are you self employed?
6) I will be submitting my Life in UK test details and apart from that I have done a masters degree in UK hence i think i don't have to go for NARIC certificates.
Fine.

Many Thanks CR001 for your quick response.

Regarding my tax filing question, I work for a company and getting a monthly salary.

So why do you need to file taxes? Tax would be taken automatically through payroll if you earned at the threshold level.

Sorry for not being precise, I meant self assessment tax returns with HMRC. I haven't done that so far as my monthly salary is very less.

Also, on the application based on your answer my understand is that

Either myself or my husband have to fill out a separate application for my son.

1) Any idea what type of supporting documents would be asked for my son for his application

2) Also, does both of our appointments have to be on the same day. Getting a super priority slot for two applications for the same day would be challenging.

Thanks in advance.

You don't need to do a self assessment!
Either myself or my husband have to fill out a separate application for my son.
It doesn't matter who completes the forum, the child is the applicant.
1) Any idea what type of supporting documents would be asked for my son for his application
The form will tell you what is needed but if under 18, just passports covering 10 years is likely the mandatory document.
2) Also, does both of our appointments have to be on the same day. Getting a super priority slot for two applications for the same day would be challenging.
Super Priority is for the UKVI application decision processing. It has nothing to do with the biometric appointment. Each applicant is individual on its own. Book appointments for biometrics as needed.
