Visit VISA Refusal - next steps

Hi, I have a few questions regarding a 6 month visit visa for my mother in law…

BACKGROUND - I’m a UK citizen by birth, my wife has held ILR for over 5 years.

I would like to be named as the person who is responsible for her during her stay here.

I would like to invite my MIL over to spend the summer with us and so she can spend time with her grandchildren, she lost her husband recently and we think a change of scenery and to spend a few months with us will help her.

She owns her own property in India but doesn’t have much money in the bank as her other daughter who lives in India financially supports her.

With regards to the visa application -

Does she apply from India or do we fill in the application here in the UK?

Can my name, address and bank statements be used to demonstrate support for her?

We have over £15k in a joint account to show we can financially support her through her stay, in addition I am self employed and can show my income.

She will be living in our house for her entire stay.

If she is granted a visa I intend to travel to India to pick her up and in addition I will be booking return flights to demonstrate she is going to return before the 6 month expiry.

Is there anything else I would need to add to the application for example travel insurance if she ever falls ill?

Doesn't matter; the end result is that she has to go to an Indian VAC for biometrics.

This all is good and well. Hovewer, you have to consider how it will look for Entry Clearance Officer.
She has no money in India, while in the UK she has a family, a house to live in, someone to take care of her.
What's the incentive for her to return? What's her ties to India?

She has a daughter, son in law and and 1 year old granddaughter which she is I’ll be looking after from the age of 2 while mum and dad work.

Is that something we could add?

There is no way she could stay with us long term and she doesn’t want to either but I don’t know how to demonstrate that.

Hi, I recently applied for a visit visa for my mother and acted as a sponsor.

it has been refused for the following -


• I have refused your application for a visit visa because I am not satisfied that you meet the
requirements of paragraph(s) V4.2 of Appendix V: Visitor because:

• You state that you intend to travel to the UK for 5 months 21 days to meet your family the UK. You state that you are unemployed, and your sponsor will be paying for your proposed trip. I note the documents and statements provided from your sponsors however, in assessing your application I must consider information regarding your intentions along with your own personal and economic circumstances.

• You state that you reside in your own property in your home country. However, I am not satisfied from the documents provided your living arrangements are as stated. The information you have provided indicates that you have immediate and extended family in the United Kingdom. You have stated you have daughter, son-in-law and two grandchildren in the UK. It is not clear what family you have remaining in your country of residence, and I am therefore satisfied that your ties to the UK outweigh those you have in your country of residence.

• You have stated that you are unemployed and have declared no personal income. The information provided do not demonstrate the income or finances of any close family members in your country of residence who may be supporting you financially. The information provided in support of your application therefore does not establish how you are supported in your country of residence or that your current economic position offers sufficient incentive to depart the UK.

• In assessing the overall credibility of your application, I am mindful of the statements made in your application form, in which you state you have not travelled internationally in the last 10 years. You now intend to enter the UK for 5 month 21 days. This, coupled with the concerns listed above relating to your ties to your home country, gives me further reason to doubt your credibility as a genuine visitor to the UK. The information provided by you does not corroborate your statements made regarding your prior international travel.

• I must take into account your personal and economic circumstances when coming to my decision. It is your responsibility to demonstrate that your personal circumstances are such that if granted leave to enter, you will comply with all of the conditions attached to any such leave and that you will leave the UK on completion of the proposed visit. However, the documents you have provided do not substantiate statements within your application. I am not satisfied you have demonstrated your personal and economic circumstances in the country you are applying from (or elsewhere) offer sufficient incentive to depart the UK.

• In light of the above, I am not satisfied that you are a genuine visitor and will leave the UK at the end of your visit. Your application for a visit visa has been refused under paragraph V4.2 (a) and (c) of the Immigration Rules.

A couple of things we didn't include that she does have a Daughter / son in law and granddaughter in India who live close by and also that her daughter works and financially supports her.

In hindsight that should have ben included.

For the next steps -

1, could we reapply with further information regarding her ties to India and financial support from her daughter?

2, if so how soon could we apply again?

3, is it worth applying for a shorter period of stay?

In next application do Address the points raised adequately.
Stating staying 5months 3 weeks out of a visa validity of 6months will most likely lead to refusal and this is seen repeatedly. Better to state few weeks.

I can address the family ties to India and financial support she receives from her daughter but with regards to visa length would 3 months still be too long?

When you say time what do you mean?

Weeks / months or maybe a year?

We were hoping to have her here over the summer but if not will wait until next year.

Will suggest minimum 7-8 months, and within the period make good any and all aspects that needs to be attended to or make good.

At this point I'll probably go less to 10-14 days. Mentioning almost 6 months as a visit has that name flagged on the system already. People keep making this mistake.

6 months isn't visiting, that's living.
