UK Dependent Visa

Post by laxmanperka » Fri Mar 08, 2024 7:31 pm

Hi, my wife recently arrived UK on a tourist Visa for 6 months. She stayed in UK for 168 days less than 180 days but Unfortunately she overstayed for 2 days than her visa expiration as she missed her flight due to traffic on the day of travel and it was her last day of visa expiry. However she travelled within 2 days back to India. Now she is planning to come back to UK on a dependent Visa as my dependent. Will there be any issue while raising a Visa as she overstayed for 2 days on her tourist Visa. Please help

Post by laxmanperka » Fri Mar 22, 2024 6:25 am

Hi, while filing my wife's dependent application i came across below question, my wife has come to UK on a tourist visa and we stayed for 5 months in UK. Now I am confused what to answer for this question will it be 'Yes' or 'No' can any one help

Have you and your partner lived together in the UK continuously since you were last given permission to stay as a partner?

Technically, the question is not applicable, if she had never been granted permission to stay as a partner. However, it may be prudent to disclose her living with you as a visitor, etc.

I would be inclined to answer no as her stay with you was under a visit visa. However I would put a cover letter in stating that during the period of her visit visa you lived together. It strengthens the connection as an existing relationship.
