ILR for myself and dependents (who yet to be completed 5 years for ILR eligibility)

Hello Team,

I have few questions (need clarification) on latest process (and any new rules) related to my ILR and my dependents(who yet to be completed 5 years for ILR eligibility).
1) My case - I will be completing 5 years on 25th May and kindly confirm -- I can apply 28 days before(which could be around after 28th April until current visa expiry date which is mid-May 2024). Also, if possible please share the ILR URL/web link to apply and list of document needed (I heard some people are giving absence letter from employer, is this required? any idea?).

2) Dependents - My dependents (wife and son) came to The UK 9 months later than me and they have same visa expiry date as myself (i.e. mid May). So I understand from other posts here that -- they need to extend their visa under Skilled worker dependent visa, kindly confirm this because some people are saying they should apply under 'Family visa' to extend their visa. Kindly clarify - Skilled worker dependents visa is correct for them? Please share URL as well.

1. Correct. Apply using form SET(O)
You need your latest payslip, bank statement and employer letter.

Form SET(O): https://visas-immigration.service.gov.uk/product/set-o


2. They should NOT switch to the family visa route at all. They will extend and remain as skilled worker dependents until eligible for ILR. This is possible even if you get ILR. Ignore what others say

For ILR - I could see the gov website: https://www.gov.uk/indefinite-leave-to- ... visa/apply I think this is correct one.

It would be great if you can clarify below as well=>
For my ILR application-- They say you can apply 28 days before the 5 yrs completion. So they are talking about application submission date or biometric date? I mean, can I fill the application and submit today and take the biometric date in 28 days span OR should I be submitting the application itself 28 days before 5 yrs completion & later biometric appointment.

For Dependents -- While filling application, do you know if application form would ask them the number of years to extend their visa? Kindly share the Gov website for Skilled worker dependent visa extension please.

Also, would you kindly suggest- dependents should submit application and go for biometric along with my ILR application? Thank you very much again.

SET(O) is the correct form for ILR. That is where you will end up if you click the link on Gov.UK webpage

The application date does not matter as much as the ILR date of decision is crucial.
I explained how things work before here: How to apply early and benefit from the date of the ILR decision ?

The Dependnat's extension visa period will be fixed, it is 3 years so you cannot request a shorter period. Their application is separate and they can apply anytime before visa expiry on their own and will attend the biometrics when booked.

I have read the explanation you have given earlier and make sense that application date does not matter but the date when Home office started processing or date of decision. Thank you for this.

Final question on dependents from my end=>

I wanted to clarify-- does 'Sponsor licence number' require for ILR (skilled worker visa route). I did not approach my employer but I think its not required for ILR, would you kindly confirm with your experience, mate? Thank you.

It's asked for as to know/confirm evidence of route culminating in your application so provide it.

Hello Friend,
I have entered the number that was given by employer but system is not recognizing this and saying => Licence number not found - please check the number. Enter your employer's sponsor licence number, not your Certificate of Sponsorship (CoS) reference number.

Guys, I have small doubt for dependent --
After filling the application (dependent partner -applying within UK) and while paying IHS they are asking few detail, one of them is -- Work start and Work end date for main applicant (as they are dependent), now I am applying for ILR for myself so not sure which dates should my wife be entering here? Would that be dates from BRP card (start and end of recent visa?) Any idea on this please?

I think I got the answer for my question in -- uk-skilled-worker-visas/skilled-worker- ... l#p2136086

Zimba suggested -- IHS application will not calculate smartly hence put the dates 3 years in future for IHS calculation.
So In my case current visa expiry date for dependent is May 2024 then May 2027 should be the end date. i.e. Work start --13 May 2024 and work end date --12 May 2027?

I am just confirming if above is correct as I do not want to enter wrong details unknowingly. I appreciate your help guys. Thanks.
