ILR for a Depedent Medical Doctor

Dear all,

I currently hold ILR under the global talent route. I am now filling out the ILR application for my wife. We came to the UK through a 5-year tier 2 visa in May 2019. In 2022, I switched to a global talent visa and applied for the ILR. Since my wife's tier 2 dependent visa was still valid, we did not switch it to a global dependent. I would appreciate it if everyone could advise on the following:

1) I have seen in the forum that I need to select “Tier 1 or Global Talent dependants”, although my wife never switched to a global dependent visa. I wonder if anyone here has an approved ILR application based on this assumption.

2) My wife is an international graduate medical doctor working in the NHS for over two years. She took the OET test in order to satisfy the English language requirement for GMC registration. After exploring gov.uk, it is clear that medical doctors do not need evidence of language requirement for the skilled worker visa pending they are registered with their professional body. However, this condition is not explicitly mentioned in the ILR section. Would it be appropriate to provide her expired OET test results and her GMC registration certificate together with a cover letter explaining this?

3) When I select the global talent depedent route, I cannot see any mandatory requirement for proof of knowledge of English. Do we still need to provide the proof?

All previous passports, travel documents or national identity cards that you have used to travel to or remain in the UK

"Tier 1 or Global Talent dependants" is correct. Under the GTV rules for ILR, the visa route of a dependant is unimportant, so no switch is necessary for them at all. Her ILR eligibility is based on your previous status as a GTV holder and she will apply to get ILR via the same route. This is according to the relevant immigration rules. She needs to sit a SELT at B1 as her vocational/professional certificate is not acceptable.

FYI Only main skilled visa holders are exempt from providing proof of English for ILR
