Child Born outside of the UK to Parents on Tier 2

Post by DAVEINTHEUK » Wed Jul 03, 2024 6:29 pm

What will be the British citizenship path for a child who was born outside of the UK to parents who are on Tier 2 visa?

We in year 3 of the 5 years under tier 2 visa and plan to apply for ILR and citizenship post that as and when eligible. What will be the path for our child if its born outside of the UK? Will it have to wait till it turns 18 to apply for the citizenship and will have to use tier 2 dependent and ILR visas till then?

Dependent visa, then ILR when both parents apply or when your spouse applies as she doesnt yet meet the requirements due to absence and then citizenship when either parent applies and the other parent and the child has ILR.

Unsure why you think the child has to wait till they are 18.

Read it in an online forum that the child may have to wait till they become an adult in order to become a citizen, probably it was for a different question.

Thank you for the reply though. So as such there is no specific benefit of the child being born in the UK or abroad is there as long as both the parents are on their way to their ILR and Citizenship.

A uk born child doesn't need a visa or ilr and has an entitlement to register as British.

A child born abroad needs a visa and ilr and can only apply for citizenship when either parent does. There is no entitlement.

The cost difference is a big one between uk and non uk born.
