Ancestry visa - ARD

Post by LindsayM1675 » Sun Aug 04, 2024 11:30 pm

We are a family of 3 all on UK ancestry visa’s. We are South African. My husband is the main applicant and myself and daughter (6 years old) are dependents. We applied for our AV from Cape Town in December 2020 and so it expires in December 2025. We were delayed in Cape Town due to Covid and renewed our AV (vignette entry clearance permit) from there numerous times. We only arrived in the UK on 30 December 2021. Because we will have only lived in the UK for 4 years when it expires, we can’t apply for ILR and would need to renew our AV. Which is incredibly costly.

I have also been told that my husband now qualifies for an ARD application as his maternal grandmother was born in the UK. He was born in 1974 in Cape Town. Thereby circumventing the huge costs of reapplying for the AV. Once he has his citizenship, our daughter would apply via MN1 and I would apply for ILR immediately after him gaining his citizenship.

Can anyone on this forum shed some light on this? Thanks

I'm not sure about this, as ARD provides citizenship otherwise then by descent - other members will comment on how feasible is that.

How would this work?
Even someone who joins a British citizen (eg spouse visa) has to spend 5 years before applying for ILR on this route.
The fact that your husband is a British citizen doesn't give you any entitlement to ILR per se.
