How long to apply for EEA2?

How long to apply for EEA2?

My husband has a EEA Family Permit and we are about to apply for the EEA2 Residence Card..

The Family Permit expires in about 3/4 days... do we HAVE to submit before the final date on the family permit?

You have to submit the EEA2 application if you intend to reside in the UK longer than 3 months.
Directive 2004/38/EC Article 9 wrote:2. The deadline for submitting the residence card application may not be less than three months
from the date of arrival.
There is no compulsion to submit the EEA2 application within 3 months of arrival in the UK.
Directive 2004/38/EC Article 9 wrote:3. Failure to comply with the requirement to apply for a residence card may make the person
concerned liable to proportionate and non-discriminatory sanctions.
Ambiguous. Still, get the application in as soon as possible after 3 months of arrival.

No need to panic! You can still apply well after the EEA FP has expired (I did! With no probs.) :)
