SET(M): When to submit Set M Form for Indefinite Leave to Remain

Post by shinydp » Wed Jul 03, 2024 6:00 pm

Entered the UK on August 1, 2019, on a spouse dependent visa. The second extension expires on November 5, 2024. Traveled outside the UK from July 1, 2023, to September 1, 2023.
When is the appropriate time to submit the SET(M) form for Indefinite Leave to Remain?

thank you .

Please refrain from creating multiple posts and stick to this thread. I assume you came here because your spouse was settled/British citizen. Your earliest date of ILR eligibility is 4 July 2024.

Note that the date you apply is not critical: Applicants can benefit from the date of the ILR decision

No, there is no such requirement. Also under the family route, there are no absence limits

Re: SET(M):Online payslip authentication

Post by shinydp » Thu Aug 01, 2024 11:44 am

Hi,
My husband's employer said, "we don’t have any provision to stamp and sign payslips and p60, you can alternatively download them from online."

Can you please advise if there are any UK visa and government requirements for payslips?

Thanks

No, such requirement doesn't exist.

Payslips can be submitted as they are provided, no stamps or signatures are required.

Documents Required for SET(M) Visa Application – Spouse's Employment Proof

Post by shinydp » Sun Aug 11, 2024 10:42 pm

Hi,

"I am applying for the SET(M) visa. My spouse has been working with the same employer for the last five years.

Is the employer's letter (which includes the duration of employment), confirmed payslips, and the P60 enough as proof?
Do we also need to submit my spouse's employment contract ?"

Thanks.

There is no need to send any contract. Read the official guide.
It tells you what is expected on this: https://assets.publishing.service.gov.u ... rement.pdf

Then provide the NARIC, assuming this was done under NARIC red route

Thanks for instant response Zimba.
I have clicked no as you have advised and it did not ask me anything about NARIC or any other english test/ degree.
The next question was regarding personal information .

I am worried that they have not asked any other question regarding English language test or NARIC Certificate

I am married in April 2012 and came to UK on 5th July 2012. I applied for FLRM along with my husband SET(O) in 2013 and my husband visa refused in April 2015 so my FLR visa refused in April 2015. I have travelled to india with my daughter around March 2016 whilst my husband is appealing for decision.
In 2018 Dec my husband was granted ILR and I have applied for New/Fresh Spouse visa in 2019. I came to UK in 2019 Aug and living continously with him since then.
I am bit confisued, should I answer yes or no to the below

Were you originally granted leave on the basis of an application made before 9 July 2012 as a partner on the family route?
Yes No

You couldn't have had a spouse visa if your spouse wasn't settled. You have stated they applied for set o, which means you likely had a pbs dependent visa (tiere 1 general maybe), which is different rules to the spouse visa flr m.

The answer to the question is still NO.

Your qualifying period for ilr starts from 2019 when you entered the uk.

Did you bother to read the advice already given or not ?
Also, you do NOT need to provide additional reasons to stay in the UK. If you answer YES to that question on the form, the form will ask for evidence and this is why you are here asking and being confused. The form should not be treated as a full disclosure

Hi Zimba,

sorry I have not read all 78 pages but from what I read and as far as my understanding it would be 18,600. correct me if I am wrong.
• those who apply on or after 11 April 2024 who are already within the 5-year partner, fiancé or fiancée or proposed civil partner routes and are applying for permission to stay with the same partner for which they were last granted permission benefit from transitional arrangements - they must meet the lower threshold of £18,600 (plus the child component), capped at a maximum of £29,000
