Can I apply under a different visa type after an appeal?

Can I apply under a different visa type after an appeal?

Hi hope someone out there can help,

I recently applied for Post Study Work Permit but was declined due to, guess what, funds/finances. I am now in the process of appealing against the decision. I am quite confident me and my partner could also apply for an unmarried partner visa, as we have satisfied all the criteria. Am I allowed to apply for this type of visa if my appeal is rejected? Or should I cancel my appeal process and go for the unmarried partner visa straight away?
