Hi mods, hope you are well.

Looks like I made a mistake in my new application. By oversight, I said 'No' to the question "Have you previously lived in a country outside the UK including your country of birth?"

Just noticed it while reading throughhttps://www.immigrationboards.com/viewtopic.php ... 4efe5b9b51

What should I do now? I haven't given my Biometrics yet. Is it okay if I mention it on the covering letter or should I again withdraw this application? ๐Ÿ˜ข
Address it in cover letter indicating what the error was and correct it.

Just to let you all know that I gave my Biometrics today. Standard application as I think it won't be considered as a priority one. Uploaded all the docs with a covering letter.

Keeping fingers crossed.

Hi team,

I finally got a reply from Home Office complaints team as follows -

Dear Mr A,

Thank you for your email correspondence of 13 May where you were advised by our customer service helpline to write to us to get a precise decision regarding your request to grant exception for staying outside of the UK for over 180 days on reasonable grounds.

Firstly, I would like to apologise for the delay in replying to your complaint, this has been due to current operational pressures. Our aim is to reply to 95% of correspondence within 20 working days. Where it is not possible to reply within this timescale, we should notify the customer and provide an indication of when a response will be issued. I am sorry that this process was not followed during the handling of your complaint.

I am unable to uphold your complaint.

I note your comment that you had previously written to us on 18 January 2023 and received no reply. Please accept our apologies for the delay and for the inconvenience this may have caused you.

In some instances, the business area concerned has already taken steps to rectify the issue whilst a complaint is pending.

As such, whilst considering your complaint, I can confirm that action has already been taken to resolve the matter you have complained about.

Does that mean the decision will be made against my reasons /grounds ??

Few minutes ago, got the following email from WorkSponsored@homeoffice.gov.uk-

"Good Afternoon,

Many thanks for contacting us. Apologies for any delays and inconvenience caused. A decision has been made against the application 1212-0001-XXXX-XXXX. You will be notified a decision has been made in due course, along with the outcome of the application. Should you require any further assistance donโ€™t hesitate to contact us.

Kind regards,

"

I haven't seen an email from the Home Office yet on the outcome. Feels like it is an unfavourable one. :( Checked my UKVI account and it still shows the following -

"You can stay in the UK until you receive a decision on your application, even if this is after 11 July 2025. This includes during any appeal or administrative review that was made in the UK within the required deadlines.

If you leave the UK, your permission to stay in the UK, which was extended by your outstanding application, will end.

If you travel outside of the Common Travel Area (UK, Ireland, Channel Islands, or Isle of Man), your current application will be treated as withdrawn.

You will need to make a new application to return to the UK."

Thanks a ton and a ton and a ton to Zimba, vinny and AmazonianX. Got the good news that my application was successful!! ๐ŸŽ‰๐ŸŽ‰๐ŸŽ‰๐ŸŽ‰๐ŸŽŠ๐ŸŽŠ๐ŸŽŠ๐ŸŽ๐ŸŽ๐ŸŽ

Can't thank enough you guys for giving me the confidence to apply, seeking discretion. The complaint I made also did work.

Finally a big headache is off. Now it's my daughter's turn. Now both me and my wife is holding ILR.

Once again thanking you!!!

I strongly advise you to apply for ILR providing all the evidence and seeking discretion. This was all due to the UKVI's policy not to issue a BRP to a visa national but such policy inadvertently prevents a visa national from flying back to the UK, as you experienced.
Congratulations. :D
It is great to see that the advice to push ahead worked out for you
