I brought my partner to the UK on a spouse visa. We had problems so he shifted to Yorkshire and worked there. He stayed there for more than 2 years. Both families agreed to this because there was no legal separation, just a temporary arrangement. Conveniently for his FLR(M), he reconciled with me. He lied on the application form that he had lived with me since the time he entered the UK. I was not aware of this. His FLR(M) was granted. Although deception was used to secure residency by lying on the form, the HO cannot do anything because his visa has been approved. If this information was presented to them before determination, then there was a possibility that his visa would have been refused because we never lived together for a continuous period. His behaviour towards me is good however I sense something wrong.
My parents are ill and old so I cannot share anything with them and I am also under cultural pressure. He doesn't have his BRP as it got lost but he does have an evisa that is linked to his passport which clearly shows that his visa is valid until 2026. He is travelling abroad next year in March for 3 weeks. Is there a way to prevent him from returning to the UK.
I know one option is for me to inform the HO and curtail his visa however this is not an option that I am considering based on my circumstances. Please can someone advice without being judgemental and provide an alternative option.
If for example I take the risk of informing the HO that my relationship has ended-
1. Will my husband receive an email or letter of curtailment via post.
2. If the curtailment email/letter is received prior to him leaving the UK for a holiday or during his visit, will he be able to return to the UK as the 60 day period would not have been expired or will he be notified at the airport by border officials and not allowed entry.
3. How long would it take for his evisa to be updated to confirm that his visa has been curtailed.
This is my last opportunity as he is unlikely to be going abroad for another couple of years. Due to Christmas, I believe it will also take longer to process curtailment issues and it is possible that he may receive the curtailment email/letter when he returns from his trip.
Any advice will be greatly appreciated.
