Dependent on HSMP old scheme

Hi guys

I have a tricky question that I can't get an answer for regarding my partner joining as a dependent on my HSMP visa


I have a HSMP visa under the old scheme. The visa (leave to remain) is valid until April 2010 (I submitted the HSMP application before the rule change in early 2008)

My partner (unmarried) is currently on the working holiday maker visa, her visa is due to expire next month (February) and we plan for her to join as a dependent on my visa.

We have been living together for 3.5 years (last 2 years in the UK) and satisfy all the requirements for getting the dependent visa (under the tier 1 rules)

My primary question is

As I was granted the HSMP visa in April 2008 under the old rules and not the new Tier 1 scheme will we have any issues;
a) because my visa is under the old rules?
b) making the dependent application 10 months after I have received my HSMP visa?

I understand the app will need to be made in our home country

Any information you could provide would be greatly appreciated
