ILR Dependent who have not completed 10 year.

Post by samy2025 » Mon Jan 20, 2025 7:50 pm

Hello All. I am in process to apply for ILR (10 yr long residency route) as I have now completed my 10 years of lawful residence. However my Spouse and child are yet to complete 10 yrs (will complete next year). My queries -
1. Can I apply for them as dependent as part of my ILR application?
2. Do they need to appear for English test to apply as dependent?

ILR Rule 11.3 - Impact to 10 yr ILR route

Post by samy2025 » Mon Jan 20, 2025 8:17 pm

Hello Team. I have a question to clarify if Rule LR 11.3 & 11.4 will have any impact to my ILR application.

I initially came to UK on ICT short term visa, after 1 year, i went back applied for ICT Long term and came back within 3 months. After that I completed my 5 years in ICT long term. Then moved to Skilled worker visa in 2021 (3 yrs) and then last extended for another year in 2024. I still have 1 year extension left on my skilled worker visa but I am looking to apply for ILR through 10 yr route. my next skilled worker extension is due in Jul'25.

I want to understand,
- If LR11.3 & 11.4 will impact my ILR application? Wordings for this rule is not clear to me so help in clarification would be great.

last extended for another year in 2024.
When in 2024 (ideally the date if in April 2024, else the month should be sufficient) was your leave extended?

1. Under the long residence route, you must apply on your own and qualify on your own. The concept of dependant does not apply here. Your dependants can extend under the same route they are under (it will be a 3-year extension as you get ILR)

2. No

Those have no relevance to you. The rules require you to have been under the current immigration ROUTE for 12 months and NOT the current visa :!:

Lawful and continuous residence changes to Long Residence route from 11 April 2024

Thanks for clarification Zimba. Followw up question - Currently I am on Skilled worker visa and due for final extension in Jul'25. Going by your response, am I correct in understanding that my dependents can continue on current visa and can get extension in July for another year under skilled worker dependent route? or extension will be for 3 year as you mentioned in your response.
