British citizen immigration to USA as member of Executive Board

Hi
I have been a member of the Exec Board of a USA based corporation (a startup) for nearly 5 years. We have been discussing the possibility of my relocation to the USA on a permanent basis and trying to understand what the options are.
For some more context - I am a British Citizen, born in India and have been working in India for the past 3 years for another mult-national. To be clear this is not the US based corp trying to get me to relocate.
I am listed a board member and shareholder on the US corp and not in any capacity on our Indian entity.
I appreciate this is an unusual combination of factors and would request some guidance here

You would require an L1 visa or H1B visa depending on what status you plan to have in the US. Immigrant or Non-immigrant.

Your prospective employer is required to file an employment based petition, form I-129H, on your behalf with USCIS but before doing so, is required to file a labor condition application with the Department of Labor concerning the terms and conditions of your contract of employment.
No sin in failing, you just have to try and try again!

I realised I didn't mention that I currently don't get paid a salary for my role. It's equity only. Does this make a difference?
