ILR (T1-Entrepreneur) delayed more than 8 months

Post by Frkhan » Wed Nov 06, 2024 12:41 pm

*Advise needed*
ILR (T1-Entrepreneur) Application Update:
Application Submitted: 16-03-2024
Last Communication (Additional Documents): 28-05-2024
It's now been over six months with no update on my ILR application. I've asked my local MP to contact the Home Office on my behalf to help resolve the delay, but there is not reply even more than 1 months. I have sent a complaint on UKVI website and still no reply.
Question:
Is there anything further I can do to speed things up? Any advice would be greatly appreciated!? what other option i can consider.

Tier 1E route is a complex route and each applicant has unique circumstances based on their business. You are subject to the 'genuine entrepreneur test' for ILR, so UKVI can ask for any evidence of business activity. It may take a while to investigate and evaluate these. We cannot tell you when that is going to be done or concluded. I suggest being patient as you cannot speed things up

Thank you very much, @Zimba. I completely agree with your points, and I have a genuine, on-ground business.

Given it’s been eight months now, I was wondering if there’s any way to check on the status. It’s been difficult to find others on the same Tier 1 Entrepreneur route, so I’m not sure if this kind of delay is typical. If you know of any similar cases, could you let me know if this is normal? Again thanx

There are a few cases reported on the forum that took over a year but mots have been successful as far as I know. So while you may have to wait a bit longer the decision could be positive. Afterall if your application was easy to be refused, it would have been refused by now

My MP received the following response from HO, which indicates there was a technical issue.

Question:
Has anyone else received a similar reply? What are the chances that they’ve now started processing applications?

"
Dear Mr. MPxxx,

Thank you for your email correspondence of 26 October 2024, and 08 December 2024 on behalf of MR. xxxx, about his application for Indefinite Leave to Remain (ILR).

Regrettably, Mr xxxx’s application is affected by a technical issue that is currently preventing us from progressing the application. We sincerely apologise for the delay this has caused and any distress this has caused him, as well as for the delay in providing you with a response.

Please be assured that we are working to resolve the issue and as soon as we have done so, we will then look to progress the application. At that point, we will also then look to provide you with a full response.

Yours sincerely,
"

Tier 1 Entrepreneur - Delay over 10 months

Post by Frkhan » Mon Jan 27, 2025 11:40 am

Hello everyone,
I applied for ILR under the Tier 1 Entrepreneur route on 26th March 2024 (biometrics submitted the same day). In May 2024, I was asked for additional documents, which I promptly submitted. However, since then, I have not received any updates from the Home Office & now its exact 10+ months.
In December, I asked my MP to follow up on my behalf. The Home Office responded, stating that there was a technical issue causing delays in providing updates. Unfortunately, it has now been almost two months since that response, and I am still waiting.
Question:
Should I consider contacting a lawyer to send a Pre-Action Protocol (PAP) letter, or would it be better to wait a bit longer? I would greatly appreciate any advice or similar experiences from the community.

I suggest complaining again and if you did not get a response for 30 days, then look at the PAP option.
