Form MN1 and Registering child

Hi

Am I correct in assuming that if I as the father of the child and a British Citizen and the mother from overseas as the spouse, on a spouse visa, that there is no requirement to register the child as British as the child will automatically gain British Citizenship?

Child is automatically British otherwise than by decent (able to transmit his nationality to his own children).

Simply apply for a passport.

The only proviso is that if they were unmarried and:

- child was born before 1 July 2006, and
- mother was not a permanent resident when child was born

then registration with the Home Office (before age 18) is required.

The original poster does say "spouse" so I'd expect they are legally married.
