Which Form ILR (LR) or 10 Years Partner Route

Hi

I wanted to ask about which form to fill in.

I've completed 10 years on the Partner Route and filled in the ILR 10 Year form which showed as Settlement Adult Relative. An immigration advisor said I should have filled in the Ilr LR form and to resubmit an application. However the guidance says not to use the LR form if I've completed 10 uears on partner route.

I should also add that I made a mistake on my initial form, when it asked if I had a Partner visa with my current partner before they got Settlement or citizenship I clicked Yes instead of No (my partner is British since birth).

Should I reapply on LR form or do the same form I did with the correct answer?

Your decision to apply under the family/partner route is correct and the advisor is wrong. If you qualify to apply under the 10-year partner/family route, you also have the option to apply under the long residence rules using form SET(LR). The advisor therefore is wrong to suggest that it is one or the other route.

FYI
You seem to have incorrectly interpreted the note on the form SET(LR). That note simply says to avoid using form SET(LR) if you intend to apply for ILR under the family/partner route rules (i.e. the 10-year FAMILY route) as you should use a different form ('adult settlement'). However, it does NOT talk about your current visa or tell you that you cannot use SET(LR) if they happen to be on the family route. Under the long residence, your current visa route is irrelevant. In your case, you had the option to apply under both routes.

The only difference is that the rules are different for each route. My suggestion is that if someone qualifies under the family route, they better stick to that as you did. The long residence has gone through several changes recently, so some people may no longer qualify.

Thank you. What should I do about the incorrect answer? Reapply and correct it (would i get a refund?) Or write a cover letter explaining that my partner has always been British?

You do not need to do anything. That is a minor error and will be ignored. UKVI uses your circumstances to make a decision

Thank you so much. One more question please.
My partner and I are married through a religious ceremony only. I chose married as my relationship status but only just realised that my previous applications (by an immigration lawyer) was an Unmarried partner. Do you think that'll cause any issues?

(I submitted the application the day of my visa expiry. After submission my old lawyer told me I had filled in the wrong form (i should've done LR) is why i have all these questions now.)

Sorry 2 questions actually.

1.) The married/ unmarried partner question from my last post.

2.) We've been asked to submit all my partners passports but we only have her passports from 2008 (2 in total). She can't find any older ones. Will they suffice?
