Hi Folks,

I(Irish / French ) just came with my fiancé No Recourse to public funds but we will get married sometimes later. Our son is Irish too.


Looking to apply for Universal Credit for the extra cost (I was told by citizen advice i am eligible for housing element despite income and child benefit) I have been in the UK for more than 1 year working full time.


I wonder if i should wait the wedding and spouse visa first ?

Is there any risk apply for UC now while my fiancé is still not resident with no National insurance number ?.

I understand that i must apply as a couple but should mention in the journal she has NRPF

You don’t need to wait, although the UC cannot be used to meet the financial requirement for a spouse visa unless you are exempt because you or your child receive a qualifying benefit eg PIP/DLA/CA. Yes you both apply for UC, link accounts and she should fail the habitual residence test and your claim will revert to a single person claim but will consider any income or capital she has.

Thank you for replying , i still have my full time job making more than 29 k required a year . No income issue for spouse visa.
