ECAA 4 ILR Eligible date confusion

Hello All
I have ECAA Turkish Bussinessperson visa and dates as below

First application 23/06/2020
Decision letter date 27/07/2020
Valid from 01/08/2020
Entry 30/08/2020

So appendix says;
When applicants can apply

“Caseworkers should be aware that applicants can apply for ILR up to 28 days before they will reach the end of the qualifying period. If they apply earlier than that, their application may be refused. The qualifying period will be 5 years immediately before the date they apply for ILR or the 5 years immediately before the date the ILR application is decided, depending on which is most beneficial for the applicant. If they have spent more than the required time in the United Kingdom, caseworkers should only consider the most recent 5 years as applicable.“

As ECAA 4 can be applied with only standard service which takes 3-4 months

In this case which date safest online and submit date?
I have seen some refusal cases due to appliyng too early 😟

This is now being asked almost daily and answered over and over again.

The qualifying period is counted from the very first date of visa approval, which for you is the first visa issue date. The 28-day concession means you will be eligible for ILR (i.e. ILR can be granted) within 28 days of completing your 5 years.

The date of ILR application is largely irrelevant. Which refusals are you talking about ??

That is a case from 2019 under the family route and as you see from the advice, the refusal was incorrect. The rules now make it clear that the date of decision should be considered and it would be unlawful not to do that.
