Claiming child benefit for my kids

Hi,

I am a British Citizen and my spouse is on FLRM visa. I have a daughter who is a Britizen Citizen and son who is on FLRM visa.

Could you please advise me on the below
1) Can I claim child benefit for my daughter who is a British Citizen, she was born in 2023. I did not claim until now fearing that this may somehow impact my spouse and son ILR applications next year.
2) Am I right in understanding that I can't claim child benefit for my son who is on FLRM visa until he gets his ILR

1. Yes - you can backdate 3 months.

2. If a the child is subject to immigration control (ie - no recourse to public funds restriction) you claiming benefits due to their presence may breach their immigration restrictions. However, I’ve never seen a case in practice where this has been an issue for a child. It’s a choice you have to make as to whether you want to take a potential albeit unlikely risk.
