Kids and Spouse ILR.

Hi everyone,

I received my ILR in July 2023 (under the Tier 2 General route) and My Citizenship in August 2024.

Now, I need to apply for ILR for my wife and our two children (who came to the UK in January 2020).

Spouse Visa valid until 4th October 2025, kids' visa valid until 5th August 2025.


The spouse passed away in the UK but has yet to fulfil her B1 English requirement.

My questions:

1) Can I apply for ILR for my spouse and kids in one application?
2) I recently changed my address and that of my elder child for the purpose of grammar school admission. How can kids present evidence of cohabitation?
3) If my spouse obtains ILR (Assuming before 5th August), can I apply for naturalisation for my children instead of applying for ILR?

1. Yes. One SET(O) application

2. Children do not have a residence requirement or need cohabitation evidence. That is only for your spouse

3. No. Non-UK born children do not have any automatic entitlement to British citizenship and they are normally expected to hold ILR for registration via discretion. Also, your children will be registered as British using form MN1 (children do NOT naturalise)

Please ask any British citizenship questions in the correct sub forum, these questions are not relevant to the ILR sub forum.

Thank you so much for your swift response @zimba.

Since the Visa expiry date is approaching for my children, can I apply for them first and then for my spouse? Or should the spouse also be included along with the children?

The children cannot apply without or before your spouse.
