I am in a very challenging situation and hoping someone with similar experience or knowledge of Indian nationality law can offer guidance.
My child was born in the UK, and both my spouse and I are Indian nationals. However, due to various circumstances, neither of us currently has any immigration status in the UK (we are refused asylum seekers on immigration bail), and we also do not have our Indian passports with us at the moment.
My child is now older than one year, and we understand that Indian citizens usually need to register a child born abroad at the Indian High Commission within one year of birth.
My key questions are:
1. Is it still possible to register a child born in the UK at the Indian High Commission after the one-year period? If so, what is the process, and are there any specific penalties or additional requirements for delayed registration?
2. How can we initiate or complete this registration process if we, as parents, do not currently have our Indian passports in our possession? What alternative forms of identification or proof of Indian nationality might the High Commission accept?
3. Does having no current immigration status in the UK for the parents affect the ability to register the child at the Indian High Commission?
Understanding whether our child can be registered as an Indian citizen is crucial for us, as it directly impacts whether they might be considered stateless. Any advice or shared experiences would be immensely helpful.
Thank you for your time and support.
