ILR SET (LR) Eligbility

Post by officialsamba » Thu Jul 10, 2025 8:35 pm

Good day,

I just wanted to ask if I will be eligible for ILR SET (LR).

1. Entered the UK in 2008, claimed asylum which was refused.
2. Overstayed and didnt make any applications till 2015. In 2015 granted 2.5 years of leave based on daughter having spent 7 years in the UK.
3. Have been renewing the same leave ever since and will be completing 10 years of legal residence.
4. After leave being granted in 2015, the first passport I got was in 2016 so I dont have a passport that covers all 10 years of legal residence.

Am I eligible for SET (LR) as I will be completing 10 legal years in August 2025 or is that route not available to me due to the past refused asylum and almost 7 years of overstay.

Thank you in advance for your help.

Probably my friend who enquired on my behalf. We live together.

Not sure what advice you are looking for. The advice was already given in that thread. If you have 10 years of lawful continuous residence, then you can apply under the long residence.

Also read: Lawful and continuous residence changes to Long Residence route from 11 April 2024

I had not seen that thread. Like I said it was my friend who enquired on my behalf and we live together. Not sure which forum he had used when he enquired. Good to know that it was this one and the advice is consistent. So to clarify the past overstay will not have an impact and I can proceed with the application?

No it is not an issue, as long as you have the required qualifying period
