Hi,
Please direct me to the old thread if it's been discussed earlier.
I am a British citizen and had to leave everything after my accident in 2018 and got settled in Pakistan. I am in Pakistan since then, had a marriage in the UK but the problems were too much so I left my wife with her parents. In Pakistan I was having mental problems and my brothers and sisters got me married. I sent a Pakistani court divorce to my first wife and never looked back till this year. During this period I got three kids but now I have serious threats and although I am happy here in Pakistan, due to these threats I want to move my family to the UK have enough savings and property here. What to do please???

I divorced her few years after but it's ok to have two wives in Pakistan. I sent her and UK embassy in Pakistan the divorce papers. Also talked to a solicitor who said that she could be considered as partner. I was mentally not thinking what I was doing, my state was really bad even I don remember coming to Pakistan. Your current marriage won't be recognised by ukvi as you were not free to marry. It doesn't matter what is accepted in Pakistan. It is not accepted in the uk to be married to two different people at the same time.

When you apply for a spouse visa, you have to provide official divorce documents evidence that you andyour current spouse were both free to marry and the divorce papers must be dated before your current marriage for the marriage to be accepted.

Ok, but we were still living together and it is fact, I was mentally sick I got the proofs of that.
The kids are 6 years 4 years and 10 months old.

I was eligible for British nationality in 2014, but applied for it in 2016 and got it. My accident was in the same year. I tried to live with my first wife, but life was impossible due to her behavior and my sickness. I almost became mad and left UK.

The advise has already been given above. You simply weren't free to marry when you did. Your kids aren't the issue here, they're obviously British by birth.

Try getting a solicitor or apply for a fiancee visa.

Not sure your mental state can impact the rules. If it's illegal, then it simply is that.

The children born to you in Pakistan after the date of naturalisation are British citizens by descent and can apply directly for a British passport.

Your second marriage will not be recognised in the UK as at the time of the second marriage, you were not free to marry in UK law.

Now that the first marriage is legally dissolved, a solution I have seen for men in your situation are that you can bring your wife to the UK on a fiance visa and then remarry her again in the UK, under UK law. I am not sure about the correctness of that solution, so wait for others to advise further on this approach.

A bigger issue that you will have is that in order to sponsor your wife to the UK, you also need to demonstrate an income of £29,000 per annum in the UK, and that you have earned such a salary for at least six months. So, even if you iron out the issues with the recognition of your marriage in the UK, you will still need to move to the UK on your own, get a job and have a salary of £2417 per month for six months before you can start the process of applying for her spouse visa (and again, that is assuming that you can get the marriage recognised in the UK).

As a British citizen, your children and you have the right to move to the UK. Your non-British family members doesn't have that right.

Thanks a lot for your help sir, acting on your advice I have applied for my kids British passports, now the applications are in the queue for examiner I don't know what does it mean. Please tell me what does it mean if application is in queue?
Before leaving UK in 2018 I had salary of more than 3500 per month. Here in Pakistan I have savings and business almost upto million pounds and have heard that can count too but it's not all in cash.

Hmpo examiner will just review whether the application complies with the rules and regulations. It’s normal, they process many thousands of passports every week.

Thanks for your reply sir, do you have any idea when I will get the decision on my kids passport applications. My documents were submitted on 16th documents received by hmpo on 18th fee deducted on 22nd and applications were put into queue on 25th. All within this month sir.

Nobody here can tell you when the passports would be processed and printed. Passports applications outside the UK takes longer. It would come out when it comes out.

Thanks sir, I checked on webchat on the 1st August and I was told by an adviser the application is with examiner and it has been through another cycle of checks. Today on 4th august I called over the phone and was told it's in the queue waiting to be picked up. I asked chat GPT it said the phone adviser didn't check properly or looked at the old notes. Not sure wanted to get a human and expert view so please help.

First child British passports applications made from the Subcontinent are known to take between six months to a year.

It is unlikely to take mere weeks. You may want to reset your expectations and wait a long while.

Just an update I have been told application of my son's first passport from Pakistan is with examiner since 1 august here is my timeline just to get an idea and give updates
1 application sent through vsf Pakistan on 16th July
2 application received by hmpo 18th July
3 Fee deducted on 22nd July
4 Email received from hmpo on 25 July
5 Application place in queue on 25th July
6 Application with examiner since 1st August
7. On 2nd august I was told the application been through another cycle of checks
6. Yesterday I was told application is still in examination

Hope it will help others in my situation to estimate their applications.
