Citizenship for child born in Uk but living abroad

First of all I want thank this forum founders and people who are looking after it. I often used it about 10 years ago and I am so happy it still exist. Much apriciated guys your time

I am in similar situation: My son was born in uk and only lived couple of months, than he moved to other country with his mum. He is now 14 years old. At the time he was born I did not have any legal status. Last two years I became British through naturalisation and I v been told he can register as a British citizen under Under Section 1(3) of the British Nationality Act 1981


How correct is that? Your opinion and time will be much appreciated

Do not tag your questions onto other topics not relevant to your circumstances.

A uk born child has an entitlement to register as British before they turn 18, once either parent obtains ILR, regardless of where the child lives.

You will need evidence of your ilr as this is what his entitlement to register is based on.

As for now I hold British passport and I sent them Permanent residence card cut in half per their request. I hope my passport will be sufficient

No, your British passport will NOT be sufficient and is irrelevant.

It is your ILR that determines the childs entitlement to register as British. Do you have a copy of the BRP card?

I just found photo copes of both side, and it’s actually valid till 2027. Do u suggest me to enclose BRP and Passport photo copies with MN1 form? Both in case?

And please one more question: because of child is 14 years old he needs be good character? and as he resides outside UK he will need criminal record check from there?

In this case, I think the naturalisation certificate (not passport, which is not definitive proof of British citizenship but merely a travel document) is sufficient.

The ILR BRP or proof of ILR is only relevant in case the child is born in the UK after ILR but before British citizenship.

Registration under Section 1(3) requires one parent of a child born in the UK to be either a person settled in the UK or a British citizen.

(3) A person born in the United Kingdom after commencement who is not a British citizen by virtue of subsection (1), (1A) or (2) or section 10A shall be entitled to be registered as a British citizen if, while he is a minor—

(a)his father or mother becomes a British citizen or becomes settled in the United Kingdom; and

(b)an application is made for his registration as a British citizen.

As for good character, yes, your child will need to meet the good character requirement. See the good character caseworker guidance.

Consider that if you apply from abroad the application may well take over 6 months. Also, if you are planning to enrol your child in a British university, I believe they will need to live in the UK for at least two years prior to enrolling, so best to check ahead of making any future plans.

Thanks for information I did not know that about university enrolment. and yes I will aply from abroad as my child lives abroad. Most likely it will take more than 6 months.

Hi guys,I have one question please: as my son is over 10 years old and will need to meet the good character requirements for registration of British citizenship, What document(s) I must provide from the country he lives? to proof he meets good character requirements… He only lived in uk for three months, since that abroad

The child needs to live in the UK for at least three years before the first day of the first year of the course, in addition to British citizenship or ILR, in order to qualify for Home Student status (in England. Rules are different in NI, Wales and Scotland) and student funding from the government.
