Spouse Visa After Divorce

Post by 777GE90 » Fri Sep 26, 2025 10:27 pm

Hello, I am looking to do a first UK spouse visa application for a family member. She previously married from abroad and sponsored her husband on a spouse visa, who arrived in the UK but it ended in divorce after 1.5 years. She informed the home office in writing and our understanding is he has falsely claimed domestic abuse and been granted ILR (but not sure).

The divorce Final Order was granted in 2023 in the UK courts and we have a copy. She re-married earlier this year and looking to sponsor her new husband on a 5 year spouse visa again.

I am planning to build the application for her for the first time (I have previously done FLR-M for my mrs).

Her salary falls short slightly below the £29K requirement so plan to use a combination of cash savings + employment.

Can you guys give me an overview of what documents are going to be required? My understanding is:
- The final order of the divorce.
- Will she need to provide proof she informed the home office? Like a copy of the e-mail or something? I don't think they ever replied.
- 6 months bank statements proving the cash savings.
- 6 months payslips, standard employment letter.

I am going to start properly looking into the application over the coming weeks, but given these circumstances do you guys think it's ok for me to apply for her (i.e. application shouldn't be too complicated) or do you think these circumstances require a solicitor?

How much savings does she have?

How much is her income short by?

She only needs to provide evidence of the divorce to prove she was free to marry. Nothing about notifying ukvi, not sure where you got this idea from.

If her new husband has been married, he also has to provide proof he was free to marry with his divorce evidence.

Her salary is probably around £24k, was recently increased (around 4 months ago). Savings around £43k, was previously around £30k but she moved money from her shared account (with parents) to her main account around 4 months ago too.
