ILR for SWV Dependant - eligibility date?

Hello everyone,

I am currently looking into the eligibility date to apply for ILR for by partner (who is still on SWV/T2 dependant visa).

She started off with this same visa category and first entered the UK on 08/03/2020 (stamp and also vignette date).

She then left on 13/03/2020 and came back to the UK on 18/08/2020: 158 days

Since then, time outside UK has been less than 15 days per annum and does not exceed the 180 day limit on rolling 12 monthly basis.

The issue is the proof of co-habitation. The earliest date we have is 03/08/2020 (council tax bill and tenancy agreement).

When should she be eligible with this proof of co-habitation? Is it the 5 year mark 28 days prior to first entry or 28 days prior to proof of co-habitation?

Cohabitation evidence is requested for the last 2 years. Even then, there are no specific requirements

Dear folks,

I am applying for my partner who is currently on a dependent Skilled Worker Visa (former Tier 2 General) since March 2020.

My partner is currently working and financially independent.

I had my ILR approved before my partner was eligible last year.

I have listed the documents to upload below, kindly let me know if I am missing anything crucial:
  • Current passport all pages
  • Expired passport all pages (has vignette with initial entry stamp)
  • Expired BRPs (x3)
  • Proof of English language
  • P60s (x5)
  • Payslip (x5, one for each year)
  • Tenancy agreement (x5)
  • Monthly bank statement (x5 over 5 years)
  • Marriage certificate
  • Council tax with both of our names (x5)
  • My bank statement
  • My pay slip
  • My expired BRP (expired 31/12/24)
Proof of co-habitation is a mix of P60s, council tax letters spread of over 5 years, bank statements and tenancy agreement for a rental. Are these ample?

A dependant does not need any financial evidence like P60s, payslips, etc.
Cohabitation does not need to be for 5 years. I gave you advice on this before as you see above :roll:
