Hi all,

I have been in UK since 2019. From 2019 till Mar-2021, I was on ICT visa. I later shifted to skilled visa. My skilled visa COS is effective from Mar-2021, but my BRP card is effective from May-2021

For ILR 5 year calculation, will it be considered from COS effective date (Mar-2021) or BRP effective date (May-2021).

COS date is irrelevant for ILR.
Because of the COVID concession, your earliest date of ILR eligibility is (your visa application date in 2021 + 5 years - 28 days)

Is there any government service (e.g. Subject Access Request Unit (SARU)), I can use to find out my visa application date?

I have switched jobs since 2021 and may not get visa application date from my old employer.

Hi Zimba,

I received the SARU response. As per that, my skilled worker application was made on 5th February, and the outcome date is 9th February 2021.

Does that mean I can actually apply on 8th January 2026 (i.e., 28 days before 5th February 2021)? Can you please confirm

That is much sooner than BRP date of May that I had in mind

Please read the advice under the link above. That is the date of earliest ILR eligibility. When you apply is less of an importance

One more query. Does the spouse (on a dependent ILR application) need to pass the English test even if she has done GCSE and a Level 2 course in the UK?

Yes. GCSE is not accepted as proof of English language level
