ILR for Global Talent Visa Dependent

I came to the UK in January 2021 on a Tier 2 visa and switched to Global Talent visa in August 2023. At the same time, my partner also switched to GTV Dependent. Since January 2024, I have been on an ILR.

Now, my partner is eligible for their ILR on 4 December (28 days before 5 years of their first Tier 2 dependent visa approval date - i.e. 01.01.2021). I have a few question and would be immensely grateful for answers.

1. As far as I have understood the guidance on Gov UK, my partner needs to fill the SET (O) for ILR application even though I do have an ILR. Have I understood that correctly ?

2. Can my partner submit their online application form in the next few days and book biometrics on/after 4 December? Or would the online application be rejected if submitted before the eligibility date of 4 December even if the Biometrics is done after their eligibility ?

Sorry for the confusion - did the "NO" for the question 2 was for the first part or the second part ?

Based on the link you sent, I assume you mean that the online application will NOT be rejected if submitted today as long as the biometrics is done after eligibility.

The date of ILR decision is all that matters. Every other date mostly becomes irrelevant
