Good Evening All,

Just a quick question please and I appreciate the time and effort of everyone involved in helping and advising people out here. I will keep it very short and straight-forward.

I have been on ILR and got my Passport in 2015 itself (on HSMP route back then).

--> The query is about my wife and child who joined me in the UK in 2014.
--> In 2015, I was advised to move them to FLR-M visa.
--> In 2020 i.e. (5 yrs later) we applied for SET-M (ILR) but my salary fell short due to COVID and job-losses.
--> Home Office moved my wife and child to FLR-FP.
--> Have been renewing both their visa since (every 2.5yrs)
--> However, during both renewals of FLR-FP (in 2022 and in 2025), the home office took over 1 year to process their renewals. I had to take MP's help to contact HO and get an outcome.
--> Now, finally a decision was received this March but with new dates of Dec 2026 as their final completion was given in their decision letters.

NOW,

My question is simple:

--> Having spent over 10 yrs in the UK legally, can I apply for their ILR i.e. SET-O please?

Or do I have to wait until their current Visa statuses run out?

Visa expiry has no relevance when it comes to qualifying for ILR. You apply for ILR whenever you qualify. Also there is no 10 years route to ILR via the form SET(O) either

If your wife has 10 years of continuous and lawful residence, then she can apply using form SET(LR) under the long residence.
