PBS dependant extension duration query

Hi, suppose a dependant partner will complete 5 years since 'date of issue of first PBS dependent visa' on December 2025, but their current PBS dependant visa runs out in November 2025, does it mean they need to renew another PBS dependent visa for 1 month before applying for ILR ?
If yes, is there any 1 month or 1 year option for such a case or do they pay for 3 years and full 3 years IHS ?
And then again pay for full ILR in 1 month ?

For context, this discrepancy was because they joined their partner later, who had originally gone to UK on a Tier 2 General visa, and since has got ILR and citizenship as well. Additionally the partner had changed sponsors in the middle, which resulted in the visa of the dependant having this odd timing and validity.

Apply for ILR shortly before visa expiry and delay biometrics till within the 28 day concession period. They have 45 working days to enroll biometrics.

Thanks, I didn't even know this was an option. I guess the next hurdle would be clearing the 'Life in the UK test' and a 'B1 SELT' exam in 1 month...

Also, I just want to clarify, that does this provision allow exactly 28 days minus the 5 year qualifying date ?

So, suppose the '5 year qualifying date' minus 28 days works out to 20th November, but the current PBS dependent expires on 11th November, is it still possible somehow ?
If it does, what would be the best date to submit the application ?

ILR for PBS dependent application

Hi, I have tried to go through some of the posts in this section about the documents required for ILR application and since some of the evidence is dependant on who we are applying for, I just wanted to ask for some guidance in this particular case.

Currently planning to apply for ILR soon for wife who is on PBS dependent currently, and needed to confirm what documents would be required. I myself was on a Tier 2, then later ILR and finally citizenship completed...

Now, for the cohabitation proofs, is a joint bank account statement and joint mortgage documents sufficient ? As we do not have many utility bills in joint names, would these be enough ?

What period should these documents cover exactly ?

These along with marriage certificate hopefully would it be fine ?

Are there any other documents required, like for dates showing travel in/out of the UK ?

Any employment related letters for the wife or myself ?

thanks, I went through it and my understanding is that we can apply for ILR directly and that the 5 year period calculation - would extend until the date of decision, which would mean that the small gap of around 10 days, due to early application gets covered. I hope my understanding is right

Correct

For cohabitation evidence, read: All you need to know about cohabitation evidence

You do not need to provide a marriage certificate. You only need to provide passports stamps covering the last 5 years. Dependants do NOT have any employment or financial requirement at all

Just some additional context, that one of the past passports was stolen during it's delivery, by the courier company, and we have the official 'Report loss' report as well in addition to some other email correspondence. We might write a cover letter explaining this and also include air tickets as alternative evidence unless you think that is not required ?

Also, another small question- Can we start draft applications of ILR and the regular visa renewal at the same time ? so in case we are not able to get everything the ILR application needs, then we can switch to the regular renewal ? (although unlikely this would happen) but just to save time and be prepared for either.

Lastly, if for whatever reason, the ILR application does not work out, or not approved due to any documents required, etc. then would we get the refund for it? and then have time to re-apply the regular renewal ?

I know we should think positively, but I just like to be prepared for any scenario and have a rough idea what the options would be then

You do not need to provide tickets. Just and explanation will be enough. UKVI relies on their own records to figure out your absences anyway.

You can open as many online applications as you like. You can only have one submitted pending application.

There will be no refunds given for a refused application which is decided and concluded.

I was looking into the Set-O form questions and wanted to confirm the following:

1) Do you have a biometric residence permit (BRP) ? Do we answer this as yes, with her last BRP details, considering her BRP card had expired in Dec 2024 and now its the new e-Visa ?


Under the section: The person you are joining or accompanying

2) Which visa is --- applying for or been granted ? Do we enter this as the last visa I was on when her dependant application was made for the first time ? which would be a Tier 2 (General) visa ?

3) Do you have one of these reference numbers for --- ? It then asks for a VAF number which I think is related to my old Tier 2 visa ? Should we say - No, I do not have a reference number for them ?

4) Similarly for this question - If they have one, what sponsor licence number? Do we just leave this blank as I am no longer on a visa.

1. BRPs are all phased out. No need to provide a BRP
Information on eVisas as all BPRs are now phased out

2. This is your previous status/route

My previous status/route was Tier 2 General before ILR

I'll check if I have the Sponsor details, but if not it's ok to leave this blank? Including the application numbers?

Re: the appointment, we plan to select a date which gets us within the 28 day concession period, so I wanted to check if we upload our required documents just before the appointment date ? or on the day of submitting the application itself ?
The reason I ask is I want to be certain that the bank statements we upload don't go out of date if we upload the documents just before the appointment date. (Bank statements need to be pre-ordered from the bank and they come by post, and take a week. The branches no longer print on demand...)

OR the date of the documents is calculated from the date of submitting the online application ?

Also, if the dependent is currently working, can they continue to work after e-Visa expiry and just share the ILR reference number with the employer ?

I had a couple other questions if you can please help me with

1) Have you previously lived in a
country outside the UK
including your country of
birth?

We have said yes due to country of birth being India. Now in the reason 'Reason you lived there' , we have just written - 'Country of birth'. Is that fine ?

2) Have you ever been refused a visa for any country other than the UK ? - In 2023, my partner was refused a Non immigrant tourist visa for the USA. She was planning to visit her relative and holiday there, but unfortunately was rejected for this reason. - ' that she was found ineligible for a nonimmigrant visa under Section 214(b) of the U.S. Immigration and Nationality Act. A denial under Section 214(b) means it was not demonstrated that her intended activities in the United States would be consistent with the classification of the nonimmigrant visa for which we applied.'

First question, is do we have to mention this and with all the reasons in the letter explained ?
Secondly, what impact does this have ? Can this be a potential reason for ILR refusal ? Also, we did not try again as some other personal matters came up and we thought that we would try again later future.

3) Lastly for the documents required to be uploaded before the biometrics, the website shows:

-Evidence of immigration status in the UK
-Declaration signed by myself to confirm consent for the Home Office to request verification checks
-All previous passports, travel documents or national identity cards that you have used to travel to or remain in the UK
Other documents:
-The passport issued by India

So, as per this, we just need to upload all the past UK BRP's, e-visa's, passports and a declaration ?
And in our case, a 'Lost Report' of one of the previous passports and a cover letter explaining how the passport was lost, and a new one had to be made..

We also have other documents like last 3 months joint bank statement which would be until 2 weeks before the date of planned online application submission, joint mortgage statements, and 1 utility bill that is issued quarterly.
But wondering under which category of documents this would fall under as it's not mentioned in the application form.?

1. Yes, it is fine. Provide minimal info

2. These have no effect on ILR unless the refusal was due to crime or serious convictions, etc. Do not overthink this

3. The list you get is generic and often not accurate. You do not need to upload BRPs or evidence of immigration. This is a legacy of the past when you had to send in your BRP, so it is not required now. BRPs are gone and UKVI knows your immigration status

Your dependant needs to provide cohabitation evidence.

Regarding this, do you mean that in the box which says -

Do you have a biometric residence permit (BRP)?

I should say No ?

Even though BRP's have expired, she was still issued one and as per Home office guidance, they can still be used for ID checks, etc. and remain valid till visa expiry for 18 months.

(Required)
This includes expired BRPs if the expiry date was less than 18 months ago.
So we are then going to answer the above as 'No' , even though we have a BRP that expired less than 18 months ago for our last leave
