ILR or Tier 2 Extension

Hi,

I am applying ILR for my wife and she came in 1st jan 2016 on a ICT Visa but later switched to Tier 2 Dependent in 2019. However, she went outside UK during her maternity leave for more than 6 months (9 months).

Her visa is going to expire on 17th dec 2025.

I am planning to apply for ILR (5 days priority one) under exceptional case and if it gets rejected because of more than 180 days absences and for some reason they rely after 17th dec then can I apply immidiately for Tier 2 extension ? i.e. how many days she will get to reapply or she cant do that ?

Her job is dependent on it so want to understand the risk. Thanks

She does not qualify for ILR, so I suggest that she applies for extension instead. Getting her ILR rejected very likely renders being unable to work, as she becomes an overstayer the moment she applies for a new extension after ILR refusal.
