ILR for my family

I am planning to apply for ILR for my family first and then British passport. Request for your advice for below please.

My current position:
- Received the ILR in 2010
- British passport received Apr 2023
- My family is on ILR dependant visa from 2010 and eligible for ILR on 30th Dec 2025
- My Kids are 17 years old and 9 years old (both were born outside of UK)

Need advice on the below please.
- What should be the application to use for my family ILR application (Is it SET(M) or SET(O) ??)
- My wife got the NARIC English Language certificate in 2010. Is it still valid ?? (This is already used for ILR dependant visa earlier)
- Can I apply for British passport for my family immediately next day once ILR is approved? Or do I need to wait until April 2026 to complete 3 years of my British citizenship.

Request to please share your responses to use the right application and process for my family ILR application.

- The British passport is only issued to British citizens, your family will have to become British citizens first before being able to get passports. Adults will naturalise using form AN1. Your spouse and children can apply after they secure ILR

Be aware that if your child gets his ILR on or after their 18th birthday, they will need to naturalise as an adult and meet all the same requirements as you (i.e. as an adult who is not married to a British citizen). That includes waiting for one year after ILR, the absence and physical presence requirements, the English language (even if they have been to a school in the UK. They are only exempt if they have completed a degree course in the UK) and LITUK tests, etc.

Any application to register them as a British citizen (without the naturalisation requirements) needs to be made before their 18th birthday. And they obviously need to have acquired ILR before that date.

I am not sure about the availability of priority or super-priority for your spouse and children. @zimba may be able to advise more on that specific point. Your eldest child won't get ILR without your spouse also qualifying. So, if priority/super-priority is available for your family, it would be best to look at booking that for at least your spouse and eldest child.

Remember that naturalisation and registration as British citizens is not a part of the immigration pathway, which ends at ILR, but is a separate process with its own different and separate laws, requirements and procedures.

My child Birth date is in May by then she will become 18.

Now we are planning apply for ILR using Super priority path and so we are assuming that my spouse and kids will receive the ILR by end of Jan.

But I complete 3 years as British citizen only by April.

My question is that do I need to wait till April to apply for Naturalisation for my spouse and kids. How it works in the following situation?
- My wife and kids will receive ILR mostly by/before end of Jan 2026
- I complete 3 years as British citizen by April 2026
- My eldest kid will become 18 years old by May 2026

My Question is -
- My kids also needs apply for Naturalisation
- When my wife & kids will become eligible for Naturalisation (is it immediately after they get ILR or only by when I complete 3 years as British citizenship)

Can you please help me with the next steps assuming my family will get ILR by Jan 2026?

That is irrelevant.

Your spouse and children can apply the same day as they receive ILR if you are already a British citizen, even if you became a British citizen the same day too.

Keep in mind that super-priority and priority slots are hard to get. They are limited and you may not get one closeby or indeed at all.

If it is before their 18th birthday, your children need to apply for registration as British citizens, which is a simpler process (no one year wait, no absence requirements, no English language or LITUK tests, etc) than naturalisation. On or after their 18th birthday, they need to apply for naturalisation with all its requirements. They do not acquire British citizenship automatically, if that is your question.

From your response I understood that my kids no need to apply for Naturalisation and directly can apply for Passport. Please let me me know if this is correct.

Your children are not British so cannot apply for a passport. Not sure how you read the response as it does not say anywhere that you can skip registration as British citizen and simply apply for a passport directly.
