Leave to remain - DLA public fund advise

Post by Mehbeel » Tue Dec 16, 2025 1:42 pm

Hi ,
I am on spouse visa and now completed 5 years and applying ILR
I have a child (british) and my husband is british,
My son has a disability and i applied DLA for him and i am the appointee on his claim and the payments come in to my bank account,
I spoke to DWP and was told my child is entitled to it and the
Money is being paid for him and i had provided them my BRP which states NRPF ( no recourse to public fund)

I am applyING ILR , i am just confused i spoke to an agent at home office advising me that i attach a letter explaining that the DLA is for my son and he is entitled to it and this should be ok ?
Spoke to 3 different immigration solicitor and was told the same that to attach a letter and this should be ok

Can anyone please advise

A letter is not needed. This should have no effect on your ILR

Thank you , but there a question in the application which states
Do you or your partner claim any of the below benefits
Which includes in list DLA , and child benefit
When i click yes it dont allow me to add details for my son on the DLA and instead asks about myself as if its for me not my son,
I am thinking to answer that No and then attach the award letter from DWP

Benefits are claimed by parents on behalf of the child

No because you did not actually claim any benefits for yourself
